Please read these Terms & Conditions (“Terms”) carefully before using https://bigduke.ai (“the Platform”) operated by BigDuke. By accessing or using the Platform, you agree to be bound by these Terms.

1. Overview

BigDuke provides an AI-powered cryptocurrency futures trading bot that connects to supported exchanges (BingX, Binance) via user-provided API keys. Our services include:

  • Automated trade execution based on AI-generated signals
  • Free tier: trading signals delivered via Telegram
  • Pro tier ($29/month): automated trading execution on connected exchanges

2. Eligibility

  • Be at least 18 years of age (or the legal age of majority in your jurisdiction)
  • Have a valid account on a supported cryptocurrency exchange
  • Comply with all applicable laws and regulations in your jurisdiction

3. Account Registration

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the confidentiality of your login credentials
  • You are responsible for all activity that occurs under your account
  • You must notify us immediately of any unauthorized use of your account

4. Exchange API Connection & API Keys

BigDuke operates by connecting to your cryptocurrency exchange account via API. All trades are executed on your exchange account — BigDuke does not hold, custody, or manage your funds at any time. Your funds remain on your exchange at all times.

API Key Requirements:

  • We strongly recommend creating API keys with trading-only permissions (no withdrawal access)
  • We encrypt your API keys using AES-256-GCM
  • You may revoke your API keys on your exchange at any time
  • We are not responsible for any issues arising from API keys with excessive permissions

By providing your API keys, you authorize BigDuke to place, modify, and close futures trades on your behalf according to the bot's algorithm and your configured settings.

5. Trading Risks

Cryptocurrency futures trading involves substantial risk of loss and is not suitable for every investor.

  • You may lose some or all of your invested capital
  • Past performance does not guarantee future results
  • Leverage amplifies both gains and losses
  • Market conditions, exchange outages, and technical issues may affect trade execution
  • We do not guarantee any specific returns, profits, or trading outcomes

6. Subscriptions & Payments

  • Pro subscriptions are billed monthly at $29/month
  • Payments are processed in cryptocurrency via NOWPayments
  • When a Pro subscription expires, all automated trading bots are automatically stopped
  • We reserve the right to change pricing with reasonable notice

Refund Policy: All sales are final. Due to the nature of digital services and cryptocurrency payments, we do not offer refunds.

7. Referral Program

  • Referral commissions are 30% of the referred user's Pro subscription fee, paid for the lifetime of their subscription
  • Commissions are paid in USDC (ERC-20) to the wallet address you provide
  • We reserve the right to withhold commissions in cases of fraud, self-referrals, or abuse
  • We may modify or discontinue the referral program at any time

8. Prohibited Uses

  • Use the Platform for any illegal purpose
  • Attempt to gain unauthorized access to our systems
  • Reverse-engineer, decompile, or disassemble any part of the Platform
  • Use the Platform to manipulate markets or engage in wash trading
  • Create multiple accounts to abuse the referral program or free tier
  • Interfere with the proper functioning of the Platform

9. Intellectual Property

All content, code, design, logos, and trademarks on BigDuke are our property or licensed to us.

10. Service Availability

We strive to maintain 24/7 service availability but do not guarantee uninterrupted access. We are not liable for losses resulting from service downtime, exchange outages, or connectivity issues.

11. Limitation of Liability

To the maximum extent permitted by applicable law, BigDuke shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including trading losses, lost profits, or data loss. Our total liability shall not exceed the amount of your most recent monthly subscription payment.

12. Indemnification

You agree to indemnify and hold harmless BigDuke from any claims, damages, or expenses arising from your use of the Platform, your violation of these Terms, or your trading activities.

13. Third-Party Services

The Platform integrates with third-party services (BingX, Binance, Telegram, NOWPayments). We are not responsible for the availability or performance of these services. Your use of these services is subject to their own terms.

14. Account Termination

You may delete your account at any time. We may suspend or terminate your account if you violate these Terms. Upon termination, your API keys will be removed and automated trading will stop.

15. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Disputes shall be resolved through good-faith negotiation first, and if necessary, through binding arbitration or the courts of competent jurisdiction.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Changes to These Terms

We reserve the right to modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
